Seventh Circuit Affirms Summary Judgment in Property Damage Case

The Seventh Circuit affirmed a summary judgment for firm client Illinois Power Company in a property damage case arising out of the collapse of a hydro power canal in Marseilles, Illinois in April 2000. The plaintiff alleged the collapse was caused in part by installation of various electric distribution facilities by Illinois Power between the 1960's and 1994. Federal District Judge Harry D. Leinenweber granted Illinois Power's motion for summary judgment on the ground plaintiff's claims were barred by the statute of limitations, and the Seventh Circuit affirmed in an opinion by Judge Wood. Sean Sullivan and Bill McFadden represented Illinois Power in the trial and appellate courts.
